By accessing or using OurWorld (the "Service"), operated by La Vaina LLC ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use OurWorld. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you must have parental or guardian consent to use the Service.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Maintain and update your information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

Your Content

You retain ownership of content you create, upload, or share on OurWorld ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.

Creator Rights

Creators maintain ownership of their original content. Similar to platforms like YouTube and Twitch, creators grant OurWorld the necessary rights to host, stream, and distribute their content through our Service.

6. Subscriptions and Tokens

Subscriptions: Paid subscriptions provide access to tokens and participation features. Subscription fees are billed in advance on a recurring basis.

Payments: All payments are processed securely by Stripe, our third-party payment processor. By making a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details.

Tokens: Tokens are used to vote and influence content. Tokens have no cash value and cannot be exchanged for money.

No Refunds: All purchases are final. We do not provide refunds for subscriptions or token purchases.

7. Streaming and Interaction

When participating in interactive features:

• You must follow community guidelines
• Your votes and interactions may influence content
• You will be matched with small groups based on our algorithms
• Chat messages and interactions may be visible to other users

8. Intellectual Property

The OurWorld platform, including its design, features, and content (excluding User Content), is owned by La Vaina LLC and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using OurWorld, you consent to the collection and use of your information as described in the Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LA VAINA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless La Vaina LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New Jersey.

15. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
